The defendants appeal from an order granting plaintiff’s motion for a new trial in an action brought by plaintiff to recover damages for the death of his infant daughter, aged two years and eight months. She was crushed beneath the wheels of a truck operated by the defendant Perez and belonging to the other defendants, when Perez started backing up the truck without observing that the child was behind it.
