The action is to recover the reasonable rental value for the use and occupation of certain apartments in the borough of Queens, New York city. There are seven defendants, The complaint alleges that all of the defendants are tenants in the same house and that each occupies a separate apartment. The reasonable rental value of each apartment is alleged, and it is not the same as to each defendant. The plaintiff demands a separate judgment against each defendant for the reasonable value of the use and occupation of the apartment occupied by him.
