This Court granted the petition for a writ of certiorari in this case to determine whether the Court of Civil Appeals wrongly decided a material question of first impression. That question is stated as follows in the petition:

"The issue is whether the [Court of Civil Appeals] erred in holding that relief was not available under Rule 60(b)(6)[, Ala.R.Civ.P.,] where the intentional omissions, deceptions and active misrepresentations of Oden's former attorney led directly to the dismissal of his action and prevented him from taking curative measures to protect his interests.
