[¶ 1] David G. Fleming appeals from the judgment entered in the Superior Court (Pe-nobscot County, Mead, J.) following a jury verdict finding him guilty of intentionally or knowingly causing the death of Lisa Garland in violation of 17-A M.R.S.A. § 201(1)(A) (1983). The issue on appeal is one of first impression in this state.
