Adrian Paul Martinez was convicted by a jury in the United States District Court for the District of South Dakota 1 of aggravated sexual abuse and sexual abuse of a minor in violation of 18 U.S.C. §§ 1153, 2241(a)(1) and 2243. Martinez appeals, challenging three aspects of the court’s ruling admitting DNA profiling evidence, the most important of which is the admission of evidence concerning DNA profiling analysis while excluding statistical probability analysis and data.
