Plaintiff Metrokane, Inc. brings this action for copyright infringement, trade dress infringement, trademark infringement and unfair competition against The Wine Enthusiast, Inc. (“TWE”), Adam Strum, Cybil Strum (collectively, the “Strums”) and Cisco Sales Corporation (“Cisco”) (collectively, “defendants”), alleging violations of 17 U.S.C. § 501, 15 U.S.C. § 1125(a) and New York State unfair competition laws.
