Plaintiff Bubble Genius LLC (“plaintiff’ or “Bubble Genius”) brings this action alleging trade dress infringement and unfair competition pursuant to the Lanham Trademark Act (“Lanham Act”) § 43, 15 U.S.C § 1125(a) and § 32, 15 U.S.C § 1114(1), New York General Business Law § 360-1 and New York State common law, against defendant Mariann Smith d/b/a Just Bubbly (“defendant” or “Ms. Smith”).
