The complaint states that Hooper, the respondent, heretofore commenced an action in the supreme court of the state of New York against Laura Spencer, wherein such proceedings were had that on the 15th day of February, 1864, judgment was duly rendered in and by said supreme court in favor of said Spencer and against said Elooper for $284.16; and plaintiff sues as assignee of said judgment.
