In 1861, the plaintiffs commenced an action against the defendant alleging as a ground thereof, that one Luther M. Brown and the defendant were, in 1859, jointly the owners (assignees) of a judgment, for the sum of $2260.20, duly rendered and entered in this court in favor of one Alfred Green, and against one Henry H. "Williams.
