Pike, J.:
Petitioner Hoppin, as widow of William Hoppin and as guardian ad litem of four minor children of the marriage, brought an action for damages against Alex Novack & Sons, a California corporation, and Murphy Johnson. Subsequently R. & M. Petroleum Company and Continental Casualty Company, hereinafter referred to as “Petroleum Corporation” and “Casualty Company,” filed another action for damages against the same defendants.
