Defendant was charged with an attempt to murder his wife. From a judgment of conviction and from an order denying Mm a new trial he appeals to this court. As his main ground for the appeal he claims that the evidence is insufficient to justify the verdict.
There is evidence to show the following: On March 13, 1924, defendant’s wife owned and conducted a restaurant known as the Boyal Barbecue, on Washington Boulevard not far from the city of Venice, in the county of Los Angeles.
