I. INTRODUCTION
This action involves an alleged breach of a commercial lease. Plaintiff Martin A. Dale owns a building located on Owen District Road in Westfield, Massachusetts. The site was last occupied by one of the defendants, H.B. Smith Company, Inc. (“Smith”). Pursuant to F.R.Civ.P. 56, Smith and co-defendant Mestek, Inc.
