Mr, Justice Hydrick.
This is an action to' recover possession of a tract of land, which plaintiffs claim as heirs of James H. Kessiah. Defendants claim as purchasers under a judgment of the Circuit Court under which the land was sold for partition amongst the heirs of James H. Kessiah. The record in that action, which defendants pleaded as an estoppel, showed that two of the plaintiffs were not parties thereto and that four of them were. The Court directed a verdict for the two who were not parties and against the four who were. The latter appealed.
