On August 31, 1995, plaintiff, Valois of America, Inc. [“Valois America”] filed this *345action against defendant Risdon Corporation [“Risdon”]. (Dkt. # 1). Valois America seeks a declaratory judgment that Risdon’s U.S. Patent No. 4,773,553 [the “ ’553 Patent”] is invalid and is not infringed by Valois America’s Seal Tight pump assembly (Count One).
