Appeal from a judgment of the superior court for Kittitas county, Gilliam, J., entered June 23, 1906, upon the verdict of a jury rendered in favor of the plaintiff, in an action for damages for the breach of a contract of employment.

This is an action for damages for alleged breach of contract. The plaintiff alleges that the contractivas reduced to writing. The terms of the writing upon which plaintiff relies arc admitted by the defendant, and the essential parts thereof are as follows:
“This agreement made and entered into this 29 th day of December, 1905, by and between the Big Store Company, a corporation of Ellensburg, Washington, 'party of the first part hereof, by its manager George ft.
