LITTLETON, Judge.

The plaintiff, a Pennsylvania corporation with principal place of business in Philadelphia, was organized June 1, 1947, and is the successor to the Frantz Equipment Company, a partnership, which, prior to June 1, 1947, was engaged in business in Philadelphia.

On December 28, 1943, the partnership entered into a contract with the United States, through the War Department, No. W-36-109-eng-279, under which the partnership agreed to supply certain labor and materials in connection with the rebuilding and reconstruction of heavy equipment for the defendant.
