The issues now before the court arise on a motion to strike the defendants demand for a jury trial.
The complaint contains two counts; the first count alleges that the defendants received for the use or occupancy of certain accommodations, rents in excess of the maximum legal rents .established by authority of Sec. 2(b) of the Emergency Price Control Act of 1942, 56 Stat. 23 as found at page 25, 50 U.S.C.A.Appendix, § 902(b).
