This is an action to recover damages for the alleged wrongful death of Mrs. Billie Baker Turner. About 12:10 A. M. on August 23, 1950, an automobile driven by her collided with a freight train of the Charleston & Western Carolina Railway Company at a spur track crossing on U. S. Highway No. 21, approximately four miles north of the town of Beaufort. Her husband, who was riding with her, was killed instantly, She died the following day as a result of injuries sustained in the collision.
