Several issues are raised on this appeal and each will be considered in turn, with each to be resolved on the particular facts of the particular record made in this particular case.

Jurisdiction to hear appeal. Respondents contend that since the appeal here is from the verdict of the jury rather than from the judgment this court lacks jurisdiction to entertain this appeal. Both the notice of appeal and the undertaking on appeal state that plaintiffs appeal “from the jury verdict.” A jury verdict is not itself an appealable order or judgment.
