The plaintiff in error, hereinafter called defendant, was convicted in the county court of McIntosh county on a charge of having possession of intoxicating liquor, and his punishment fixed at a fine of $50 and confinement in the county jail for a period of 30 days.

The evidence offered by the state was that John Kidd, a deputy sheriff in McIntosh county, had been notified that the defendant was drunk on the highway near the town of Hitchita in said county; that witness found the defendant drunk under a bridge and arrested him; that defendant said he had some valuable papers in a suitcase in…
