OPINION AND ORDER
LAGUEUX, Chief Judge.
This matter is before the Court on the petition of plaintiffs Victor Wilbert and Stephen J. Wilbert (hereafter referred to as “plaintiffs”) to overrule the removal of this action from the Rhode Island Superior Court for Kent County to the United States District Court. This, in reality, is a motion to remand, pursuant to 28 U.S.C. § 1447(e) and the Court will treat it as such.
