MEMORANDUM OPINION AND ORDER
FABER, District Judge.
Pending before the court is plaintiffs motion to remand this action to the Circuit Court of Summers County, West Virginia (doc. # 5). For the reasons stated herein, plaintiffs motion to remand is DENIED.
