Benson, J.:

This is an action to recover damages for personal injuries suffered while working upon a public road. The question is whether the township is liable.

The road is one of the public highways which the board of county commissioners of Wyandotte county is authorized to improve and maintain by chapter 276 of the Laws of 1899. In pursuance of section 2 of that *675act the township board had proceeded to grade the Kaw valley road. At the time of the accident work was in progress filling up and widening a place in the grade.
