Presently before us is the disposition of an adversary proceeding (“the Proceeding”) instituted by ANDREW E. WILLIAMS (“the Debtor”) against GELT FINANCIAL CORPORATION (“the Defendant”) to recover statutory damages for alleged disclosure violations of the federal Truth in Lending Act, 15 U.S.C. §§ 1601 et seq., (“the TILA”), in two separate consumer loan transactions; to declare the attempted rescission of these transactions effective and obtain a broad range of remedies as a result of the Defendant’s failure to properly respond to same; and…
