In an action by an unpaid subcontractor, the defendant Board of Education (the Board) appeals, as limited by its brief, from so much of an order of the Supreme Court, Westchester County, dated July 26, 1976, as denied its motion for summary judgment dismissing the amended cross complaint of defendant P. M. Hughes & Co. (Hughes) for failure to state a cause of action by reason of its failure to allege the presentation of a written verified claim to it within three months after accrual of the claim, pursuant to section 3813 of the Education Law.
