—In a proceeding to permanently stay the arbitration of claims arising under a construction contract, K. Capo-lino Design and Renovation, Ltd. appeals from an order of the Supreme Court, Rockland County (Edelstein, J.), entered August 3, 1983, which granted the petitioner’s application, and denied its cross motion, inter alia, for leave to serve a late notice of claim pursuant to Education Law § 3813 (2-a).
