Plaintiffs, Frederick Rivers, by his mother Ellen, Elizabeth McBride, Gloria Saeed, Margaret Demasi and Larry Capp, on behalf of themselves and all others similarly situated, brought this action for declaratory and injunctive relief against the Secretary of Health, Education and Welfare [hereinafter referred to as “the Secretary”], the Commissioner of the Social Security Administration, the Commissioner of the New York State Department of Social Services and the Administrator of the Human Resources Administration of the City of New York.
