Appeal from a judgment of the superior court for King county, Tallman, J., entered November 5, 1915, in favor of the plaintiff, on motion for judgment on the pleadings, after striking parts of the answers in garnishment proceedings.

This is a proceeding in garnishment under ch. 130, Laws of 1915, p. 357 (Rem. 1915 Code, § 680-1). It presents a question for first impression in this state meriting full consideration. The facts are as follows:

On August 31, 1915, plaintiff recovered a judgment in the superior court for King county against the principal defendant, Robert T. Hodge, who was then and now is sheriff of King county. On September 30, 1915, plaintiff sued out a writ of garnishment directed to Byron Phelps, as auditor of King county, and German-American Mercantile Bank, a corporation.
