The claimant in this workmen’s compensation case while in the course of his employment on February 17, 1933, received severe third-degree burns of his left side when powder in a cartridge he was handling ignited. The case has a long history, having been before referees five times. Some reference to the course it followed is necessary.

Shortly after the accident, an agreement was entered into whereby compensation was paid claimant for total disability. This agreement was terminated by Referee Hess, and claimant was awarded compensation for partial disability. On September…
