In this workmen’s compensation case the claim petitions were filed under the provisions of the Pennsylvania Occupational Disease Act of June 21, 1939, P. L. 566, 77 PS Sec. 1201. The referee found that the claimant-decedent’s total disability and subsequent death were caused by anthraco-silicosis, but disallowed compensation on the ground that notice of disability was not given the defendant within the time limit prescribed by the act.
