Defendant Illinois Central Railroad Company, as assignee, is successor to all the right, title and interest conveyed in 1879 to its predecessor, the Champaign, Havana, and Western Railway Company, by Lewis W. Ross and wife, as owners in fee of a ioo-foot strip of land located in Havana, Mason county, “for the purpose of constructing, maintaining and operating thereon a single or double track railway, with all the necessary appurtenances.” Plaintiff, Forster I.
