The petitioner moves for summary judgment in a proceeding brought under article 78 of the Civil Practice Act in the nature of mandamus to compel his reinstatement to the position of unemployment insurance field superintendent in the Division of Placement and Unemployment Insurance (DPUI), from which position he was dismissed on December 27, 1949, under substantially the circumstances hereinafter set forth.
