This case is before the Court on Defendant’s Motion for Summary Judgment on both counts of Plaintiffs Complaint. Plaintiffs Complaint sounds in Rhode Island law, and alleges (1) that Defendant’s failure to pay her long-term disability insurance claim represents a breach of its contract with her; and (2) that the breach is a violation of Rhode Island General Laws §, 9-1-33, which provides a cause of action against an insurer who wrongfully and in bad faith refuses to settle or pay a claim.
