This case is before the Court on both Defendant’s Motion for Summary Judgment on Plaintiffs Complaint, and Plaintiffs Cross Motion for Summary Judgment on the issue of liability only. Plaintiffs Complaint originally alleged two violations of the law of the State of Rhode Island: (1) that Defendant’s failure to pay her long-term disability insurance claim represented a breach of its contract with her; and (2) that the breach is a violation of Rhode Island General Laws § 9-1-33, which provides a cause of action against an insurer who wrongfully…
