This was an action in ejectment for the recovery of the possession of certain real estate described in the complaint as 130 Pine Street, Asheville, N.C. It was commenced by the issuance of summons on 17 July, 1940, which was personally served upon the defendants on 27 July, 1940, and was heard before his Honor, Frank M. Armstrong, and a jury, at the September Term, 1940, of the Superior Court of Buncombe County.
