This is an action to recover taxes paid under protest under the provisions of section 12665, O. S. 1931, 68 Okla. St. Ann. § 263.

It was instituted in the district court of Tulsa county on the 28th day of November, 1939, by the Public Service Company of Oklahoma, as plaintiff, against Joe T. Parkinson, county treasurer of Tulsa county, as defendant.

The questions involved relate to the validity of the prior annexation of territory to independent school district No. 22 of Tulsa county and the distribution of the tax burden to satisfy pre-existing indebtedness of district No. 22 by the…
