PARAS, J.

The State Personnel Board (Board) appeals from a judgment of the superior court ordering the issuance of a peremptory writ of mandate. The writ commands the Board to set aside and reconsider its decision affirming petitioner Wilson’s dismissal from employment.

Wilson, a fish and game warden in the Santa Cruz area, was dismissed on January 21, 1968, after 21 years with the Fish and Game Department. The department’s notice of punitive action stated that the dismissal was based upon (1) inefficiency, (2) inexcusable neglect of duty, (3) dishonesty and (4) misuse of state property…
