In 1856 the defendant was engaged in carrying passengers from the port of San Francisco, in this State, to San Juan del Sur, in Nicaragua, and the action is brought for the breach of a contract to convey the plaintiff, Mary A. Jones, who was then unmarried, from the former to the latter port, and for wrongs and injuries sustained by her in consequence "of the violation of the agreement.
