This case was referred pursuant to Buie 45(a) to Mastin G. White, a trial commissioner of this court, with directions to make findings of fact and recommendations for conclusions of law which the commissioner has done in a report filed July 13, 1959. Although plaintiffs did file an intention to except to the commissioner’s findings and recommended conclusion of law, they did not within the time permitted by the rules of this court file exceptions and brief.
