WORTENDYKE, District Judge.

The second amended complaint in this action seeks treble damages for alleged violations of Sections 2(a), 2(d) and 2(f) of the Robinson-Patman Act, 15 U.S.C.A. §§ 13(a), 13(d) and 13(f), and Sections 1 and 2 of the Sherman Act, 15 U.S.C.A. §§ 1 and 2. The statutory provisions are set forth below. 1

Though the present complaint resembles its precursors, the fundamental activity complained of having been the same in each succeeding pleading, a marked increase has occurred in the length and scope of the complaint. The original complaint against one defendant contained…
