METZNER, District Judge.

Plaintiff, a franchised distributor of the products manufactured by defendant Admiral Corporation, asserts claims under sections 2(a), (d) and (e) of the Clayton Act (Robinson-Patman Act), sections 1 and 2 of the Sherman Act, and for breach of contract.

Plaintiff originally moved for a seprate trial of the issue as to whether Newark was a purchaser or customer within the meaning of the Robinson-Pat-man Act, or a distributor within the meaning of the distributor contract between plaintiff and defendant.
