Clarke, J.:
This action was brought to recover about $6,000 damages for the conversion by the defendant-of a number of checks, and of the pro*637ceeds thereof, belonging to plaintiffs. Plaintiffs reside and do business in Paris, France, as general commission merchants. In 1901, and for some time prior thereto, they had an agency in the city of New York, and one Martin Cassidy was their agent in charge, receiving and forwarding orders from their customers and making sales arid collections under written agreements defining his authority.
