Magi XXI, Inc. (“Magi” or “Plaintiff’) initiated this action by complaint filed July 17, 2007. Plaintiff filed a first amended complaint (“FAC”) on October 29, 2007. Gerald P. Colapinto (“Colapinto”) and Second Renaissance, LLC (“Second Renaissance”) (collectively, “Defendants”)1 now move this Court to dismiss the FAC in its entirety on the basis of claim preclusion (res judicata) and issue preclusion (collateral estoppel) in light of a prior litigation filed in the Southern District of New York {“Magi I”).2 Though the licensing pro-,…
