—Order unanimously modified on the law and as modified affirmed without costs in accordance with the following Memorandum: Plaintiffs commenced this action to recover for injuries sustained by plaintiff Richard Foster (plaintiff) as a result of slipping and falling on ice in the parking lot of the shopping center owned by defendants Spevack and Statewide Plaza Shopping Centre (collectively, Spevack).
