*782In an action to recover damages for personal injuries, etc., the defendant Brooklyn Union Gas Company appeals from so much of an order of the Supreme Court, Kings County (Velasquez, J.), dated May 11, 2009, as denied its cross motion for summary judgment dismissing the complaint and all cross claims insofar as asserted against it.
Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the cross motion of the defendant Brooklyn Union Gas Company which was for summary judgment dismissing the Labor Law § 240 (1) cause of action insofar as asserted…
