This is an appeal by the defendant from a judgment entered in favor of the plaintiff in the sum of $23,500, upon a verdict of a jury recovered in an action of trespass on the case instituted under the Federal Employers’ Liability Act, Cahill’s St. ch. 114, ¶ 321 et seq., by the plaintiff against the defendant to recover damages for injuries sustained by him on June 8, 1931, while he was assisting in the unloading of scrap rail from a freight car in the defendant’s Corwith yard in Chicago, which rail was consigned to the defendant…
