WIDENER, Circuit Judge.
Plaintiffs, Howard G. Dawkins, Jr., and Annette Dawkins, appeal the district court’s order granting summary judgment in favor of defendant James Lee Witt, the director of the Federal Emergency Management Agency (FEMA). Dawkins v. Witt, No. 4:98-CV-124-F3 (E.D.N.C. Feb. 26, 1999). The plaintiffs own property insured under the National Flood Insurance Program that was damaged by Hurricane Fran.
