The several defendants have appealed from orders of the lower •court overruling demurrers to the complaint. The lower court certified the questions involved as important and doubtful.
The background of the litigation is this. Theodore B. Sheldon, a resident of Goodhue county, died testate ip 1900. By his will, after certain devises and bequests had been made, he provided the residue was to be given his executors in trust.
