JACKSON, District Judge.

INTRODUCTION

This matter comes before the Court upon the United States’ motion for summary judgment, 1 filed on February 23,1996 pursuant to Rule 56 of the Federal Rules of Civil Procedure. The United States initiated this action on April 27, 1995 to recover a principal amount of $185,383.82 plus interest, representing an overpayment to Defendant by the United States Department of Labor (“DOL”) in the form of workers’ compensation benefits.
