Appellee, Buford Owens, by next friend, George Mahurin, sued appellant for damages for personal injuries received by appellee as the result of a collision between one of appellant’s interurban cars and a wagon drawn by two mules in which appellee was a passenger at a point in Hill county whore appellant’s railway crosses the public wagon road. The negligence alleged as the proximate cause of the injury was the failure of the agents and servants of appellant to sound the whistle or give other warning of its approach, and the speed at which the car was operated in the light of the conditions…
